1.  About this Policy

Heyday Marketing Pty Ltd (88 126 239 076) trading as Maps Marketing and Maps Merchandise (MAPS, we, us or our) provides marketing, design, web development and maintenance and merchandise services. This Privacy Policy (Policy) sets out how MAPS Marketing collects, holds, uses, discloses and protects Personal Information. It applies to all Personal Information we handle, including information about website visitors, clients and their personnel, and individuals who appear in images used for marketing purposes.

Maps Marketing complies with the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) (Privacy Act). Where the Privacy Act does not apply to us, we apply the APPs as our minimum standard. By dealing with us or using our website, you agree that your Personal Information will be handled in accordance with this Policy.

2.  Definitions

APPs: the Australian Privacy Principles set out in the Privacy Act.

Personal Information: information or an opinion about an identified individual, or an individual who is reasonably identifiable, including a person’s name and contact details and images in which a person is identifiable.

Sensitive Information: Personal Information of the kind defined in the Privacy Act, including information about a person’s racial or ethnic origin, health or religious beliefs.

You: an individual whose Personal Information we hold, including website visitors, client personnel and individuals appearing in images.

3.  Websites and digital products we provide to clients

Where Maps Marketing designs, builds or hosts a website or digital product for a client, the client determines the purposes for which Personal Information collected through that website is handled, is responsible for that information and must maintain its own privacy policy. Maps Marketing handles that information on the client’s behalf, in accordance with its agreement with the client and this Policy. This Policy governs Personal Information that Maps Marketing collects and handles for its own purposes.

4.  Personal Information we collect

Maps Marketing collects only the Personal Information reasonably necessary for its functions and activities. This may include:

  • Client and contact details: names, positions, business and email addresses, telephone numbers, and information exchanged in the course of providing our services.
  • Website enquiries: the details you submit through a contact or enquiry form, including your name, email address, telephone number and message.
  • Website analytics and diagnostic data: technical and usage information collected through cookies and analytics tools (including Google Analytics), such as device and browser type, pages viewed and general location. We retain this data only briefly and delete it on a regular basis, currently weekly.
  • Images: photographs, video and other images of individuals, which may include school-aged students, staff and members of school communities, collected or created for marketing and promotional use.

5.  How we collect Personal Information

Where reasonable and practicable, Maps Marketing collects Personal Information directly from you. We also collect Personal Information from third parties, including schools and other clients who provide images and related information, and from publicly available sources. Where we collect your Personal Information from a third party, we take reasonable steps to ensure you are made aware of the matters in this Policy, unless an exception under the Privacy Act applies.

You may deal with us anonymously or by using a pseudonym where it is lawful and practicable to do so, although we may be unable to provide certain services if you do.

6.  Images of students

Maps Marketing uses images only for the marketing and promotional purposes agreed with the relevant client. The following terms apply:

  • Responsibility for consent. Where a school or other organisation engages Maps Marketing, that organisation is responsible for obtaining and maintaining all consents required from students and their parents or guardians before images are captured and before they are provided to us. Maps Marketing acts on the authority and instructions of that organisation and relies on it having obtained those consents.
  • Permitted use. Maps Marketing uses images only for the purposes agreed with the client. We do not sell images and do not use them for unrelated purposes.
  • Withdrawal and removal. On notice that a consent has been withdrawn, or that an image should no longer be used, Maps Marketing will cease further use of that image and remove it from materials within its control as soon as reasonably practicable. We cannot recall materials already printed, distributed or published by a third party.
  • Maps Marketing will not use the image of any individual identified to us as subject to a non-publication direction or child protection requirement, and we require clients not to provide images or details of those individuals.
  • Children’s privacy. Maps Marketing handles children’s Personal Information consistently with the best interests of the child, and will update its practices to meet the Children’s Online Privacy Code when it takes effect.

7.  Purposes of collection, use and disclosure

Maps Marketing collects, holds, uses and discloses Personal Information for purposes including:

  • providing and administering our marketing, design, web development, hosting and merchandise services;
  • producing marketing materials, publications and websites for clients;
  • communicating with you and responding to enquiries;
  • business administration, including billing, records and quality assurance; and
  • direct marketing of our own services in accordance with clause 9.

We may use or disclose Personal Information for a secondary purpose related to the primary purpose of collection where permitted by the Privacy Act, including where you would reasonably expect it.

8.  Sensitive Information

Maps Marketing does not seek to collect Sensitive Information. An image may nonetheless reveal Sensitive Information, such as a person’s racial or ethnic origin. Maps Marketing will only collect, use or disclose Sensitive Information with consent, or where otherwise permitted or required by law, and only for a purpose for which it was provided or a directly related secondary purpose.

9.  Direct marketing

Maps Marketing may use your business contact details to send you marketing communications about its services where permitted under APP 7. Each marketing communication includes a simple means to opt out. You may opt out at any time using the unsubscribe facility or by contacting us, and Maps Marketing will give effect to your request within a reasonable period. Maps Marketing does not sell or rent Personal Information to third parties for their marketing.

10.  Disclosure and service providers

Maps Marketing may disclose Personal Information to:

  • our personnel and contractors who require it to perform their duties;
  • service providers that support our business, including information technology, hosting, email and analytics providers, which are required to handle Personal Information consistently with this Policy;
  • a client, where the information was collected for or on behalf of that client;
  • any person to whom you have consented to disclosure; and
  • any person where disclosure is required or authorised by law.

Some service providers, including analytics providers such as Google, may store or process data outside Australia. Where Maps Marketing discloses Personal Information to an overseas recipient, it takes reasonable steps to ensure the recipient handles the information consistently with the APPs.

11.  Security of Personal Information

Maps Marketing takes reasonable steps to protect Personal Information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include access controls, secure systems, and secure storage and disposal. No method of transmission or storage is completely secure, and Maps Marketing does not warrant that Personal Information will be free from unauthorised access in all circumstances.

12.  Retention and destruction

Maps Marketing retains Personal Information only for as long as necessary for the purposes set out in this Policy or as required by law, after which it takes reasonable steps to destroy or de-identify it. Website diagnostic data is retained briefly and deleted on a regular basis, currently weekly. Images are retained for the period agreed with the relevant client. Certain records may be retained for minimum periods required by law.

13.  Access and correction

You may request access to the Personal Information Maps Marketing holds about you, and request correction of information that is inaccurate, out of date, incomplete, irrelevant or misleading. Requests should be made in writing using the contact details below, and Maps Marketing may require verification of your identity. Maps Marketing does not charge for making a request but may charge a reasonable fee for giving access. Maps Marketing may decline access or correction where permitted under the Privacy Act, and will give written reasons and information about how to complain where it does so.

14.  Accuracy of Personal Information

Maps Marketing takes reasonable steps to ensure the Personal Information it holds is accurate, up to date and complete. Please notify us if your details change or if you believe any information we hold is inaccurate.

15.  Cookies and analytics

Our website uses cookies and analytics tools to enable the website to function and to collect the diagnostic data described in clause 4. You can configure your browser to refuse cookies or to notify you when cookies are used; however, parts of the website may not operate properly if you do.

16.  Third-party links

Our website and materials may contain links to third-party websites. Maps Marketing is not responsible for the content or privacy practices of those websites, and their inclusion does not imply endorsement. You should review the privacy policy of any third-party website you visit.

17.  Data breaches

If Maps Marketing becomes aware of an eligible data breach that is likely to result in serious harm, it will respond in accordance with the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) where required.

18.  Complaints

If you have a complaint about how Maps Marketing has handled your Personal Information, please contact our Privacy Officer using the details below. Maps Marketing will acknowledge your complaint and respond within a reasonable period. If you are not satisfied with our response, you may complain to the OAIC at www.oaic.gov.au or on 1300 363 992.

19.  Changes to this Policy

Maps Marketing may amend this Policy at any time. The current version applies from the date it is published on our website, and your continued dealing with us or use of our website constitutes acceptance of the amended Policy.

This Policy is governed by the laws of Victoria, Australia.
