Terms & Conditions
To ensure clients fully understand all responsibilities during a project, MAPS Marketing requires them to read and understand the Terms and Conditions. If there are any queries regarding these Terms and Conditions, clients are encouraged to contact MAPS Marketing to discuss any concerns before accepting them. Once a school instructs MAPS Marketing to commence work, this instruction is taken as acceptance of the Terms and Conditions.
MAPS Marketing –Â
Terms and Conditions of Quotation and Sale
These Terms and Conditions govern the quotation and sale of all products and services supplied by Heyday Marketing Pty Ltd, trading as MAPS Marketing. Unless otherwise expressly agreed upon in writing between a duly authorised officer of MAPS Marketing and the client, these Terms and Conditions shall apply, notwithstanding any provisions to the contrary that may appear on any order form or other document issued by the client.
General
MAPS Marketing quotations are valid for 30 days from the date of issue.
All orders placed with MAPS Marketing are subject to these Terms and Conditions. MAPS Marketing reserves the right to alter these Terms and Conditions at any time, with such alterations taking effect upon notification to the client.
If a client cancels or alters an order or part of an order after MAPS Marketing has received it, MAPS Marketing reserves the right to charge additional costs incurred up to the date of such cancellation or alteration.
Terms of Payment
All payments must be made in full within seven (7) days of invoicing. Payment may be made via direct electronic deposit or cheque.
In the event of a delinquent account, MAPS Marketing is entitled to recover all costs associated with collecting overdue payments, including legal costs and disbursements. Additionally, MAPS Marketing may suspend any further delivery of services or products to the client.
Copyright and Ownership
All ideas, designs, concepts, artwork, compositions, symbols, and logos prepared or developed by MAPS Marketing remain the absolute property of MAPS Marketing. Clients may not use such material in any media until payment is made in full. The copyright in any ideas, designs, artwork, compositions, symbols, and logos created by MAPS Marketing remains vested in MAPS Marketing.
Upon full payment, MAPS Marketing assigns to the client the copyright of the finished work. However, MAPS Marketing retains ownership of draft concepts, draft electronic artwork files, compositions, symbols, and logos created during the project but not utilised by the client. MAPS Marketing also retains ownership of all electronic artwork files used to create the final design.
MAPS Marketing reserves the right to use any artwork or design for its own promotion and portfolio purposes. An industry-standard ‘designed by’ link may be added to the client’s website, which will remain unless otherwise negotiated.
Supply of Content
Unless otherwise negotiated or unless MAPS Marketing’s copywriting services are engaged, clients must provide text in a text file format at the start of the project. Graphics (logos, images, etc.) must also be supplied before work begins. Text should be as close as possible to the final format, with content, spelling, and grammar checked.
Images should be provided in the highest resolution electronic format possible, such as logos in Illustrator/Photoshop format or high-resolution JPEG files (300 dpi). MAPS Marketing assumes that all supplied content adheres to copyright laws and that necessary permissions and royalties for images have been obtained by the client.
Revisions
Unless otherwise quoted or negotiated, projects include up to three rounds of changes. Any revisions beyond this will incur additional charges at an hourly rate. Clients will be advised and their agreement sought before any additional work incurring extra costs is undertaken.
Sign Off
MAPS Marketing specialises in marketing and communications but does not provide proofreading services unless specifically requested. While MAPS Marketing is knowledgeable about schools, the client remains responsible for ensuring that all content is accurate, including spelling, grammar, and punctuation.
Clients are required to carefully review all artwork files and notify MAPS Marketing of any necessary changes. Approval via email constitutes acceptance of all associated costs and final responsibility for the content.
Quotes and Payment
Once a quote is received, clients must review it to ensure all requirements are understood. Any queries should be addressed with MAPS Marketing before proceeding. If the client is satisfied with the quote, they must confirm their acceptance via email before work commences.
Project Timeframes, Structure, and Changes
Both parties are expected to adhere to agreed-upon timeframes. While MAPS Marketing strives to meet deadlines, client cooperation in supplying necessary content and reviewing drafts is essential. Delays on the client’s part may affect the final deadline.
If a client is uncontactable for an extended period or delays the project without reasonable cause, MAPS Marketing reserves the right to deem the project complete and invoice accordingly.
If project requirements change or additional work is requested, the initial quote will be reviewed and adjusted accordingly. Clients will be informed and their agreement obtained before any additional charges are incurred.
Force Majeure
MAPS Marketing shall not be liable for any failure or delay in the supply or delivery of products or services due to circumstances beyond its control. These include, but are not limited to, war, strikes, industrial disputes, government restrictions, transport delays, fire, power outages, hosting failures, equipment breakdowns, theft, vandalism, riots, civil unrest, accidents, or acts of terrorism.
